Purchasing rules
1. Definitions:
1.1. Seller – VĮ “Registrų centras” of the Republic of Lithuania, Register of Legal Entities Vilnius branch, registered private legal entity EURODIGITAL UAB. Company code 300638881, VAT payer code LT100002890717, registered office address Žemaičių str. 31, LT-44175, Kaunas, Lithuania.
1.2. Thermal-Vision.eu – e-shop located at www.thermal-vision.eu
1.3. Buyer – an active, adult natural person or a minor natural person (from 14 to 18 years of age) who has the consent of parents or guardians when purchasing www.thermal-vision.eu e-shop; legal person.
1.4. Parties – Buyer and Seller.
1.5. Personal data – any information related to an individual – name, surname, place of residence or other data provided during www.thermal-vision.eu registration.
1.6. Rules – purchase-sale rules, which establish the rights and obligations of the Buyer and the Seller, the procedure for purchase, payment, delivery, exchange or return of goods and other clauses provided for in this agreement.
1.7. Account – the result of the buyer’s registration, which stores the customer’s data, which he provides during registration, order history and invoices.
1.8. Privacy Policy – a document approved by the Seller, which provides the basic rules for the collection, storage, processing and storage of Personal Data using the www.thermal-vision.eu e-shop.
2. General provisions
2.1. Buyer before purchasing goods in the thermal-vision.eu e-store, must check the box next to the statement “I have read and agree with the rules of purchase and sale of goods”. This consent is considered a legal document that sets out the rights and obligations of the Buyer and the Seller, the procedure for purchase, payment, delivery, exchange or return of goods and other clauses provided for in this agreement.
2.2. The Seller reserves the right to change, amend or supplement the Rules at any time, taking into account the requirements established by legal acts. The Buyer is informed about the changes in the Rules by logging in to his account on thermal-vision.eu e-store or by e-mail. When placing a new order, the Buyer will have to re-read and confirm the Rules.
3. Point of sale, purchase-sale agreement
3.1. The agreement between the Buyer and the Seller is considered concluded from the moment when the Buyer, having selected the purchased item (s) and formed a shopping cart, clicks on the link “Pay”.
3.2. Every Buyer’s order is stored in the thermal-vision.eu database.
4. Buyer’s rights
4.1. The Buyer has the right to purchase goods and order services from thermal-vision.eu in accordance with the procedure established by these Rules.
4.2. The buyer has the right to withdraw from the purchase and sale agreement concluded with the thermal-vision.eu online store by sending a free-style e-mail. Email to info@thermal-vision.eu no later than within 14 (fourteen) days from receipt of the goods.
4.3. The Buyer has the right to change or return the purchased goods in accordance with the procedure established by the Rules.
4.4. The Buyer has other rights established in the Rules and legal acts of the Republic of Lithuania.
5. Obligations of the Buyer
5.1. To buy in the e-shop, the buyer must provide the following personal data: Name, surname, recipient’s address, e-mail, telephone number. In order to create an account for other purchases, the Buyer must come up with a password which he undertakes not to disclose to third parties. The buyer is responsible keeping thermal-vision.eu e-store login data secure. Due to lost e-store accounts or suspicions that they are used by third parties, the Buyer must notify the Seller by e-mail info@thermal-vision.eu.
5.2. The buyer is responsible for the accuracy of the data provided. In the event of a change in personal data (delivery address, telephone number, etc.), the Buyer must immediately inform the Seller.
5.3. The buyer has the right to cancel the registration at any time. In the thermal-vision.eu store, you can do this by informing by e-mail info@thermal-vision.eu. After canceling the registration, the Buyer can re-register and regain the right to purchase thermal-vision.eu e-store.
5.4. The Buyer agrees to receiving information messages to the e-mail address or telephone number specified by him, which are necessary for the execution delivery of the goods.
5.5. Buyer using thermal-vision.eu e-store must fulfill its obligations, comply with these Rules, Privacy Policy, other conditions clearly indicated on thermal-vision.eu and do not violate the legal acts of the Republic of Lithuania.
5.6. The Buyer must pay for the ordered goods or services and accept them in accordance with the procedure established by these Rules.
6. Seller’s Rights
6.1. The Seller has the right to suspend or terminate the activities of thermal-vision.eu. In this case, all accepted and confirmed Buyers’ orders are terminated and new orders are not accepted.
6.2. If the Buyer tries to damage the stability, security of thermal-vision.eu or does not fulfill its obligations, the Seller has the right to immediately and without prior notice restrict or suspend the Buyer’s access to thermal-vision.eu or, in exceptional cases, cancel the Buyer’s Account.
6.3. The Seller has the right to limit or cancel the Buyer’s account if the Buyer behaves inadequately in the public space of thermal-vision.eu (writes offensive comments, uses uncensored words, etc.).
6.4. The Seller has the right to cancel the Buyer’s order if the Buyer does not pay for the order within 3 days.
6.5. Due to incorrect data provided by the Buyer (eg: recipient’s address) if the contacts specified in the Account cannot be contacted, the order will be canceled within 3 days if the Buyer does not contact the Seller himself.
6.6. The Seller has other rights established in these Rules and legal acts of the Republic of Lithuania.
7. Obligations of the Seller
7.1. The Seller undertakes to provide the Buyer with the opportunity to use the services provided by the thermal-vision.eu e-shop under the conditions set forth in these Rules.
7.2. The Seller undertakes to respect the privacy of the Buyer and to process the Buyer’s Personal Data only in accordance with the Rules and the legal acts of the Republic of Lithuania.
7.3. Inform the Buyer by e-mail or telephone about the termination or suspension of the order due to possible unforeseen reasons. The Seller may offer the Buyer a similar product or allow the Buyer to choose for himself (for the relevant amount), if the Buyer does not agree, the money will be refunded (if a pre-order has been made). Money will be returned within 7 days.
7.4. The Seller undertakes to deliver the goods ordered by the Buyer to the address indicated by the Buyer (the Buyer is responsible for the purposefully provided data of the recipient).
8. Prices of goods, payment procedure and terms
8.1. The prices of the goods in the thermal-vision.eu online store and in the formed order are indicated in euros (including the amount of VAT tax valid at that time according to legal acts).
8.2. After placing the order, the Buyer can pay using the payment system (After selecting this payment method, you will be immediately directed to the payment system (operated by SEB), where you will see the payment made).
8.3. When the seller receives the payment, the shipment preparation time starts to count (the shipment is shipped the same business day if the order was placed before 5 p.m.).
8.4. By approving the Rules, the Buyer agrees that the purchase documents – invoices, which are also warranty certificates for the goods, should be submitted to him electronically at the e-mail address specified in the Buyer’s registration form. Invoices shall indicate the goods selected, their quantity, the discounts granted, the final price of the goods, including all taxes, and any other information required for the approval of the accounting legislation.
9. Delivery of goods
9.1. The goods are delivered to the buyer by courier within 1-10 days (courier terms).
9.1.1. The buyer must provide the exact address for delivery of the goods.
9.1.2. The buyer undertakes to accept the goods himself. A valid identity document (identity card, passport or a new model driving license) must be presented upon acceptance of the goods. If the Buyer cannot accept the goods himself and the goods have been delivered to the address specified by the Buyer, the Buyer has no right to make claims to the Seller regarding the delivery of the goods to the wrong person.
9.1.3. The goods are delivered by the Seller or his authorized representative.
9.2. The Seller delivers the goods to the Buyer in accordance with the terms specified in the descriptions of the goods. These terms are preliminary and do not apply in cases when the required goods are not in the Seller’s warehouse and the Buyer is informed about the shortage of the goods ordered by him. At the same time, the Buyer agrees that in exceptional cases the delivery of goods may be delayed due to unforeseen circumstances beyond the control of the Seller.
9.3. The Seller is released from liability for violation of the terms of delivery of goods, if the goods are not delivered to the Buyer or are not delivered on time due to the fault of third parties unrelated and / or independent of the Seller or due to circumstances beyond the Buyer’s control.
9.4. At the time of delivery of the goods to the Buyer, the Buyer must together with the Seller or his authorized representative check the condition of the consignment and the goods (ies) and sign the consignment delivery-acceptance document. After the Buyer signs the delivery-acceptance document, it is considered that the goods have been delivered in proper condition, there are no violations, the cause of which is attributable to non-factory defects, and no discrepancies in the product (s). If you notice that the packaging of the submitted product is damaged (wrinkled, wet or otherwise externally damaged), the product (s) is (are) damaged and / or the product (s) is (are) not in the correct configuration, the Buyer must note this in the delivery-acceptance document of the goods and, in the presence of the Seller or his representative, draw up a report on the violation / non-conformity of the free-form shipment and / or the goods. If the Buyer fails to do so, the Seller shall be released from liability for damage to the goods, when the cause of such damage is not a factory defect and for discrepancies in the assembly of goods only if these discrepancies can be identified during the external inspection.
9.5. The risk of accidental loss of or damage to the goods passes to the Buyer from the moment the goods are handed over to the Buyer.
9.6. If the Buyer does not collect the goods within the set deadline or fails to accept the delivery and the Buyer has paid for the goods and their delivery, the representatives shall contact the Buyer regarding another time and / or method of delivery of the goods. If the Buyer still does not collect the goods or fails accept them, such goods are returned to the Seller, the order is canceled and the Buyer is refunded, excluding the bank charges for the seller, bank transfer fee, etc. if applicable.
10. Product quality guarantee and expiration date
10.1. The characteristics of each product sold by thermal-vision.eu are indicated in the product description attached to each product. If you have not found the right information, you can contact the Seller by e-mail info@thermal-vision.eu, more detailed descriptions will be provided if possible.
10.2. The Seller is not responsible for the fact that the goods on thermal-vision.eu in their size, shape, color or other parameters may not correspond to the actual size, shape, color or other parameters of the goods used by the Buyer or other technical reasons beyond the Seller’s will. The buyer is advised to read the product description.
10.3 All thermal-vision.eu goods are granted a minimum 24 month warranty.
10.4 The Buyer, who considers that his rights have been violated, must contact the Seller in writing and set out his claims no later than within three months from the date of the violation. The seller must examine the request free of charge within 14 days and provide a detailed and reasoned written response based on documents. If the problem cannot be solved, the Buyer has the right to apply to the entity resolving consumer disputes out of court (State Consumer Rights Protection Service, address Vilniaus St. 25, LT-01402 Vilnius, www.vvtat.lt) or to a court.
10.5 Disputes concerning goods purchased online from an EU-based Seller can be resolved via the Electronic Dispute Resolution (EGS) Platform, available at https://ec.europa.eu/consumers/odr/.
11. Return and exchange of goods
11.1. Low-quality goods are exchanged or refunded in accordance with the laws of the Republic of Lithuania. Items must be returned within 14 days from the date of receipt of the goods.
11.2. In order to return the product (s), the buyer must send a free RMA form request email to info@thermal-vision.eu.
11.3. When returning defective goods, the Buyer is asked to send proof of defective goods – photos by e-mail. Email info@thermal-vision.eu.
11.4. When the buyer returns the goods, the following conditions must be met:
11.4.1. the returned product must be in the original neat packaging.
11.4.2. the product must be unused, without losing its commercial appearance (undamaged labels, peeled off protective films, etc.)
11.4.3. the returned goods must be in the same configuration as received by the Buyer;
11.5. The Seller has the right not to accept the goods returned by the Buyer if the Buyer does not follow the procedure for returning the goods set out in this article.
11.6. In all cases, the money for the returned goods is transferred by original payment method and only to the payer’s bank account.
12. Liability
12.1. The buyer is responsible for the secure storage and / or transfer of his login details to third parties. If login details for thermal-vision.eu are used by a third party who has logged in to thermal-vision.eu using the Buyer’s login data, the Seller considers this person to be the Buyer.
12.2. The Seller is released from any liability in cases where the loss arises due to the fact that the Buyer, despite the recommendations of the Seller and its obligations, did not read these Rules, the Privacy Policy, even though he was given such an opportunity.
12.3. In the event of damage, the guilty party compensates the other party for the direct damage.
13. Exchange of information
13.1. The Seller shall send all notices during the registration of the Buyer or when ordering the goods to the e-mail address specified by the Buyer or by SMS message to the telephone number specified by the Seller in accordance with the procedure provided for in these Rules.
13.2. The buyer sends all notifications and questions to info@thermal-vision.eu by e-mail.
14. Final provisions
14.1. These rules have been drawn up in accordance with the legal acts of the Republic of Lithuania.
14.2. The law of the Republic of Lithuania shall apply to the relations arising on the basis of these rules.
14.3. Any disagreement arising from the implementation of these rules shall be settled by negotiation. If no agreement is reached, disputes are settled in the Republic of Lithuania.
